GENERAL TERMS AND CONDITIONS OF SALE
The holder of all rights to the carape.net website is the company Virtual Trade j.d.o.o. (hereinafter: Virtual Trade).
Virtual Trade j.d.o.o., Budicinova ulica 20, 52100 Pula, Hrvatska, OIB: 17377827209, Entered in the court register of the Commercial Court in Pazin.
Through the said website, Virtual Trade j.d.o.o. provides sales services via its platform – the carape.net webshop (hereinafter: carape.net). By using the services of the carape.net webshop and all associated pages and services within the carape.net domain, it is considered that consumers are at all times familiar with these terms of sale and that they fully understand and accept them.
These terms apply to the rights and obligations arising from the conclusion of a distance sales contract between the consumer as the end customer and the carape.net webshop and are considered an integral part of such contracts.
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
Virtual Trade j.d.o.o. reserves the right to amend the General Terms and Conditions on the carape.net website at any time and without prior notice. All changes are binding on users.
SECTION 1: LIMITATION OF LIABILITY
Virtual Trade j.d.o.o. assumes no responsibility for any consequences arising from the use of the carape.net website and its content.
As delivery times, prices, and product characteristics change rapidly, Virtual Trade j.d.o.o. may occasionally fail to update information on the website, but it strives to ensure the highest possible accuracy and timeliness of the data. In the event of incorrect application (including pricing), Virtual Trade j.d.o.o. will inform the customer and allow them to cancel the contract or replace the ordered item.
Virtual Trade j.d.o.o. may cancel a contract only in the event of an obvious error. An obvious error includes errors in essential product characteristics and any other errors which, according to standard business practice, are considered decisive for withdrawing from concluding a contract between the parties, including obvious pricing errors.
Virtual Trade j.d.o.o. endeavors to ensure smooth operation of the online store, but errors may still occur. In such cases, Virtual Trade j.d.o.o. undertakes to remove the error as soon as possible after discovery.
Access to the website may be temporarily disabled due to technical difficulties or maintenance, which may prevent the use of the online store. In the event of technical issues, Virtual Trade j.d.o.o. reserves the right to cancel orders that are incorrect due to technical errors. In such cases, customers will be notified as soon as possible and instructed on further steps.
Users must ensure appropriate protection of their equipment (e.g., antivirus software) before using the website. Customers are responsible for maintaining the security and confidentiality of login data (email and password), and are solely responsible for maintaining the security of their account credentials and for all of their account activity.
Product photographs are illustrative only and may not correspond in all details to actual products. Due to individual monitor settings and differences in color perception, full color accuracy as displayed on users’ screens cannot be guaranteed.
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To the fullest extent provided by law, in no case shall carape.net, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licencors, or those of Shopify and its affiliates, be liable for any injury, loss, claim, or any direct, indirect, incidental, puntive, special or consequential damages of any kind, including without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, wheter based in contract, tort (including negligence), strict liabillity or otherwise, arising from your use of any of the services or any products procured using the services, or any other claim related in any way to your use of the services or any productm, including but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the servuces or any content (or product) posted, transmitted, or otherwise made available via the services, even if advised of their possibility.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
SECTION 2: LIMITED RIGHT OF USE AND OUR PRODUCTS
Visitors to the carape.net website may use its content exclusively for personal and non-commercial purposes. The content is protected by copyright. Any other use, copying, publication, or distribution of the website content or any part thereof without permission from Virtual Trade j.d.o.o. is prohibited.
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
SECTION 3: ORDERS
A sales contract between the seller and the customer in carape.net webshop is concluded at the moment the seller sends the customer the first email regarding the status of their order. From that moment, all prices and conditions are fixed and apply equally to both the seller and the customer.
This email does not confirm product availability or shipment. The email only informs the customer that the order has been received and that the availability check has begun. The customer is the person whose details were provided at the time of order submission. Subsequent changes to customer details are not possible.
The sales contract (i.e., the first email regarding order status) is in electronic form and stored on the Virtual Trade j.d.o.o. server.
When you place an order, you are making an offer to purchase. carape.net reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until carape.net confirms acceptance.
We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as carape.net may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4: PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.
Prices posted in our online stores may be different from prices offered in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (1) the credit card information you provide is true, correct, and complete, (2) you are duly authorized to use such credit card for the purchase, (3) charges incurred by you will be honored by your credit card company, and (4) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.
VAT has not been charged in accordance with Article 90, paragraph 2 of the VAT Act (exempt from VAT payment; the taxable person is not registered in the VAT system).
At Virtual Trade j.d.o.o. we care about the environment, that is why the receipts/bills are generated and delivered exclusively via e-mail to the e-mail address You provide upon ordering. If You wish to receive a physical (printed) copy of the receipt/bill, please send Your request immediately after creating and submitting Your order, to our e-mail: info@virt-trade.com. Kindly add the order number in the e-mail as well and You will receive a physical copy of the receipt/bill to the address You provided for the order delivery.
SECTION 5: SETTLEMENT OF DISPUTES
In the event of a dispute between the Customer and the Seller, the parties will attempt to resolve disputes amicably; otherwise, the competent court shall be the court which holds jurisdiction.

RETURN OF PRODUCTS
SECTION 1: WITHDRAWAL FROM PURCHASE VIA A WRITTEN FORM
In accordance with Article 79 of the Consumer Protection Act, the customer has the right to withdraw from the purchase within 14 days by sending written notice to the email address: info@virt-trade.com. The 14-day period begins on the day the ordered goods are received/delivered.
In the electronic written notice, the customer must clearly state the decision to withdraw from the purchase (including name and order date).
If desired, the buyer may use the following form:

SECTION 2: PRODUCT RETURN
If the customer has already received the goods and withdraws from the purchase, they must return the received goods within 14 days following the written notice referred to in the previous section. To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. A copy of the original receipt must be enclosed with the returned product.

If your return is accepted, we’ll send you instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.
The company must issue a refund of the paid amount no later than 14 days from the date of receipt of the returned goods and after confirming that the returned item is in compliance with the description mention above. Please remember it can take some time for your bank or credit card company to process and post the refund too.

The cost of returning the goods is borne by the buyer, unless the product has a material defect or the wrong product was delivered.
SECTION 3: COMPLAINTS
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.
If the customer has any complaint in accordance with Article 10 of the Consumer Protection Act, please notify us by email at: info@virt-trade.com
The seller is liable for material defects of the goods sold on its website in accordance with applicable regulations, in particular the Croatian Obligations Act and the Consumer Protection Act.
In the notice of defect, please note that you are obliged to describe the defect in detail and allow the seller to examine the defect.
Your purchase order is stored with Virtual Trade j.d.o.o., and you can access the order at any time through your account in the online store. Upon receipt of the goods, carape.net will provide a written response regarding the resolution of the complaint within 8 days of receiving the written notice and the product.
Complaints sent via parcel delivery must be properly packaged in cardboard packaging.
Any complaints that are improperly packaged and show visible mechanical damage incurred during transport will not be accepted and will be returned to the sender.
Please note that the customer bears the return costs.
DELIVERY
SECTION 1: SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.
Delivery is carried out by GENERAL LOGISTICS SYSTEMS CROATIA d.o.o. (GLS) at a cost further explained in the checkout area.
GENERAL LOGISTICS SYSTEMS CROATIA d.o.o. delivers packages to islands (Brač, Cres-Lošinj, Dugi Otok, Hvar, Korčula, Krk, Murter, Pag, Pelješac, Rab, Šolta, Ugljan-Pašman, Vis, Lastovo) according to a delivery schedule located on their official website.
GENERAL LOGISTICS SYSTEMS CROATIA d.o.o. reserves the right to change the “Delivery Schedule for Islands and Smaller Locations” without prior notice due to technical difficulties or force majeure.
We ship internationally. Customs, duties, taxes, and any import fees may apply, and are the customer's responsibility.
SECTION 2: PAYMENT METHODS
Available payment methods in the online store:
- Cash on delivery (postage is paid by the customer upon receipt of the goods)
- Card payments: Visa, Mastercard, Maestro, Diners (issued by all banks)
Card payments are processed through Shopify Payments which is powered by Stripe, which enables real-time payments by credit and debit cards and other payment methods.
Shopify Payments powered by Stripe ensures secure data entry and transfer, confirmed by PCI DSS certification, the system is PCI DSS Level 1 compliant, ensuring the highest level of payment card industry standards.

Any and all personal data is processed in compliance with GDPR.
Until full payment of the purchase price, the selected products remain the property of Virtual Trade j.d.o.o. Virtual Trade j.d.o.o. reserves the right to change the available payment methods listed on the carape.net website.
INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by carape.net, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of carape.net, Shopify or any third party. Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by carape.net.
carape.net’s names, logos, product and service names, designs, and slogans are trademarks of carape.net or its affiliates or licensors. You must not use such trademarks without the prior written permission of carape.net. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third party functionality). RELATIONSHIP WITH SHOPIFY
carape.net is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with carape.net. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and carape.net, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with carape.net.
PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here (https://carape.net/policies/privacy-policy), and certain personal information may be subject to Shopify’s Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.

INDEMNIFICATION
You agree to indemnify, defend and hold harmless carape.net, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.
SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

SECTION 21 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the territorial courts in Republic of Croatia. You and carape.net consent to venue and personal jurisdiction in such courts.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website.
